These terms can be customized further with specific pricing (£X, £Y, etc.) based on your quotes. Recommend consulting a legal professional to finalize for compliance.1sExpert30 sourcesAdd GDPR compliance clausesHere are GDPR/UK GDPR compliance clauses you can add to your Onsite Care Plan, Maintenance Contract, and Extended Warranty terms on www.wirewizards.net. These are tailored for a small UK-based IT/network installation and support business like Wire Wizards, where you (as the service provider) will typically act as a processor of personal data on behalf of your clients (the controllers), such as when accessing CCTV footage, network logs, customer contact details, or device configurations during maintenance, inspections, or support.
These clauses draw from the mandatory requirements under Article 28 of the UK GDPR and ICO guidance. They are written in clear, professional language suitable for your website and contracts.
You can insert a new section titled Data Protection and UK GDPR Compliance at the end of each plan/contract (before the governing law/termination sections), or as a standalone section that applies to all three offerings.
Data Protection and UK GDPR Compliance
Compliance with Data Protection Laws
Both parties shall comply with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and all applicable data protection legislation (together, the "Data Protection Laws").
Roles of the Parties
For the purposes of the Data Protection Laws:
The Client is the data controller and determines the purposes and means of processing personal data.
Wire Wizards is the data processor and processes personal data only on the documented instructions of the Client and in order to provide the services under this agreement (including inspections, maintenance, testing, troubleshooting, and support for CCTV, WiFi, fibre, telecoms, Starlink, or related systems).
Wire Wizards shall not process personal data for its own purposes unless required by law.
Processing Instructions
Wire Wizards shall process personal data only:
On the Client’s documented instructions (including as set out in this agreement or as otherwise agreed in writing); and
As necessary to perform its obligations under this agreement.
If Wire Wizards is required by law to process personal data otherwise, it shall inform the Client of that legal requirement (unless prohibited by law).
Confidentiality
Wire Wizards shall ensure that all persons authorised to process personal data are subject to an obligation of confidentiality (whether contractual or statutory).
Security Measures
Taking into account the state of the art, the costs of implementation, and the nature, scope, context and purposes of processing, as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, Wire Wizards shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk. This includes measures to protect against unauthorised or unlawful processing and against accidental loss, destruction or damage.
Sub-processors
Wire Wizards may engage sub-processors to assist in providing the services. Wire Wizards shall inform the Client of any intended changes concerning the addition or replacement of sub-processors and give the Client the opportunity to object. Where a sub-processor is engaged, Wire Wizards shall impose on that sub-processor obligations at least as protective as those set out in this clause.
Assistance to the Client
Wire Wizards shall provide reasonable assistance to the Client (at the Client’s cost) in:
Responding to data subject rights requests (e.g., access, rectification, erasure);
Meeting the Client’s obligations regarding security of processing, data breach notification, and data protection impact assessments (where required); and
Providing information necessary to demonstrate compliance with the Data Protection Laws.
Data Breach Notification
In the event of a personal data breach, Wire Wizards shall notify the Client without undue delay (and in any event within 48 hours of becoming aware of the breach) and provide reasonable assistance to enable the Client to meet any statutory reporting obligations.
Deletion or Return of Data
Upon termination or expiry of this agreement (or earlier at the Client’s written request), Wire Wizards shall, at the Client’s election:
Return to the Client all personal data processed under this agreement; or
Delete or securely destroy all such personal data,
unless required by law to retain it. Wire Wizards shall confirm in writing that this has been done.
Audits and Inspections
Wire Wizards shall make available to the Client (or an auditor appointed by the Client) information reasonably necessary to demonstrate compliance with its obligations under this clause and shall allow for and contribute to audits or inspections (subject to reasonable notice and confidentiality protections).
International Transfers
If personal data is transferred outside the United Kingdom to a country that does not benefit from an adequacy decision under the UK GDPR, such transfer shall be subject to appropriate safeguards, such as the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses, or another mechanism permitted under the Data Protection Laws.
Liability
Each party’s liability for breaches of this Data Protection clause shall be subject to the liability limitations set out elsewhere in this agreement, except where liability cannot be limited or excluded under the Data Protection Laws.
These clauses can be adapted slightly depending on whether a specific contract involves unusually high-risk processing (e.g., large-scale CCTV with facial recognition), but for typical Wire Wizards services they should provide solid compliance coverage.
Recommendation:
Add a short note on your website privacy policy page explaining how you handle personal data during service visits.
Consider having clients sign or accept these terms explicitly when booking or signing up for a plan.
For full legal peace of mind, have a solicitor review the final wording, especially if you ever act as a joint controller or process special category data.
